§ 1 Scope

These terms and conditions regulate the contractual relationship between you as a natural person and us, Sneaky-Shoes Sàrl, and only apply to business relationships with consumers within the meaning of § 13 BGB. According to this, every natural person is considered a consumer who concludes a legal transaction for a purpose that can neither be attributed to their commercial nor their self-employed activity. The terms and conditions apply to the offers on the domainSneakfit /maxlahma.wixsite.com. We carry out your order according to our terms and conditions valid at the time of the order. The most current version of our terms and conditions is available on our website (www.sneakfit.com) at the bottom of each individual page.

§ 2 Contract Languages

Contract languages are German, English and French.

§ 3 Ordering process / conclusion of contract

You can contact us on the internet via our homepagewww.sneakfit.comor order by phone.

The presentation of the products in our online shop represents a binding offer within the meaning of § 145 BGB.

You have the option of initiating the ordering process in your shopping cart by clicking the "Checkout" button. After entering your personal data, you will find a summary of your order in the final step of the ordering process. Here you can check your order again and correct it if necessary. By clicking on the "Send order" button or placing an order by telephone, you make a binding offer for the items you have selected. After submitting your order, you will receive an e-mail from us confirming receipt of your order (order confirmation). However, this e-mail does not constitute acceptance of the offer you have made, but merely informs you that we have received your order. Only with a further e-mail in which we confirm the dispatch of your article (dispatch confirmation) or the order does the contract acceptance take place on our part. Your contractual partner is Sneaky-Shoes Särl. You can find your order data in your account, which you can view under the "Login" button after entering your e-mail address and your password.

 

§ 4 Delivery

Within Germany, we deliver the goods in stock within 14 days  to the address you specified. When shipping outside of Luxembourg and within Europe, delivery can take up to 30 days for items that are in stock. The delivery time for shipments outside of Europe depends on both the shipping method (by airmail / by land / by ship) and the recipient location.

All of the above information about expected delivery dates and periods are non-binding. Unless these have been expressly agreed as binding between SneakFit and you. If we are in default of delivery in the case of an expressly agreed delivery date and you grant us a grace period, this shall be at least 14 days. If we let this period of grace pass without result, you are entitled to withdraw from the purchase contract. If an item cannot be delivered in a timely manner or not at all, we will inform you immediately about the alternative delivery date or that the delivery cannot take place.

§ 5 cancellation policy

You have the right to withdraw from this contract within 14 days without giving any reason. The cancellation period begins on the day on which you or a third party named by you who is not the carrier took possession of the goods (your order). To exercise your right of withdrawal, you must inform us (Sneaky-Shoes Sàrl, 12, rue de la Gare, L-1234 LUXEMBOURG, phone: (!352) 42 11 10 11, email:contact@sneakyshoes.store) before returning the goods, to revoke this contract. You can do this for thisUse model cancellation form, which, however, is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you withdraw from this contract, we will owe you all payments that we have received from you, including delivery costs (with the exception of additional costs that arise if you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within 14 days from the day on which we received notification of your cancellation of the contract. In doing so, we use the same means of payment for the repayment that you used for your transaction, unless something else was expressly agreed with you. Under no circumstances will you be charged a fee for the repayment. However, we can refuse the repayment as long as we have not received the goods back or have proof that you have sent the goods back to us.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you informed us of the cancellation of this contract. The deadline is met if you send off the goods before the period of fourteen days has expired. If a free item is added to the purchase of a product, it must be sent back unused when the order is canceled (return). If this is not the case, the official sales price of the corresponding free item will be applied.

The direct costs of returning the goods will be borne by us.

You only have to pay for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

§ 6 Returns/reversals

Please fill out the return form in the lower section completely and legibly and enclose it with your return. Pay particular attention to the completeness of your bank details, as we are not liable for financial disadvantages due to incorrect account details. Please use the enclosed return slip to return the goods. You can drop off your return at any Deutsche Post branch and send it back to us free of charge. If your order does not include a return slip, please send your return insured to the following address:

When returning the goods, please use the packaging material that came from us or pack the items in such a way that they reach us in good condition. When returning shoes, please do not use the shoe box as the only outer packaging, but use the shipping bag, packing paper or another box, as resale with a damaged shoe box is not possible.
Even if the above requests are not observed, your right of return remains unrestricted. Also pay particular attention to the completeness of your bank details. We are not liable for financial disadvantages that have arisen due to incorrectly provided account information.

§ 7 Prices

All prices quoted are shown as euro contributions. They are final prices including any applicable statutory value-added tax. Postage and shipping costs are added according to the list under paragraph 8.

§ 8 Postage & shipping costs (domestic/abroad)

Here you will find all information about postage and shipping costs for deliveries.

a) within Luxembourg

Shipping is free of charge for every delivery within Luxembourg.

b) abroad

We charge a flat rate of €5.99 for each delivery abroad.

§ 9 Terms of Payment

We accept payment in advance, by PayPal, by immediate transfer or by credit card. If your place of residence is outside Luxembourg, payment is only possible by credit card or PayPal. In some European countries, payment in advance is also possible. For technical reasons, it is unfortunately not yet possible to set off a credit balance for orders placed over the Internet.

a) Payment in advance

We will send you an order confirmation of your order by email. After the amount has been credited to our account, the goods will be shipped.

b) PayPal

Payment is made immediately with your PayPal account to our PayPal account with the addresspaypal@sneakyshoes.com. Please note that tickets cannot be paid for with PayPal.

c) Immediate transfer

Payment is made directly via your online banking account. After entering your access data and the corresponding TAN number, the payment will be made to our bank account within 3-4 working days.

d) credit card

We accept VISA, Mastercards and Maestro cards. Payment processing is encrypted via iPayment and thus offers you secure handling of your data and fast and uncomplicated payment processing.

§ 10 Warranty

Warranty rights apply. In the case of complaints, we ask that you provide proof of the date of purchase by means of a copy of the invoice, which must be sent with the item to which the complaint is made to the following address:

Normal wear and tear of the goods do not justify any warranty claim.

§ 12 Care

Please note the washing instructions that you can find on the labels of the items. We are not responsible for damage caused by incorrect cleaning.

§ 13 Retention of title

All delivered goods remain the property of SNEAKY-SHOES Sàrl until full payment has been made.

§ 14 Data storage

We strictly adhere to data protection. You agree to the storage, processing and use of the personal data transmitted to us through your order in accordance with the provisions of the Federal Data Protection Act (BDSG) for the processing of your order. Your stored personal data will only be passed on to the responsible transport company for the dispatch of your goods. All personal information will be treated confidentially. For marketing purposes, we exchange data with other mail order and service companies. If you have agreed, your personal data will be passed on to these mail order and service companies. Your interests worthy of protection will be taken into account by us.

§ 15 Right of objection according to the Federal Data Protection Act (RGPD)

As a data subject, you have the right to object to the use or transmission of your data for advertising purposes (blocking indicator) under the RGPD. In addition, there is a right to information and, under certain conditions, a right to correction, blocking and deletion of your data stored in one of our files. This is also your contact person if you want to exercise your right of objection according to the BDSG.

Section 16 Limitation of Liability

Sneaky-Shoes Sàrl is only liable for damage other than injury to life, limb and health if this damage is based on intentional or grossly negligent action or on culpable violation of an essential contractual obligation by Sneaky-Shoes Sàrl or its vicarious agents. An obligation is essential to the contract, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the buyer can regularly rely. Any further liability for damages is excluded. Claims from a guarantee given by Sneaky-Shoes Sàrl for the quality of the object of purchase and the Product Liability Act remain unaffected. According to the current state of the art, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. We are therefore not liable for the constant availability of our internet shop.

Section 17 Applicable Law

Luxembourg law shall apply to all disputes arising out of or as a result of this agreement, to the exclusion of the UN Sales Convention.

§ 18 Online Dispute Resolution

The European Commission provides a platform for out-of-court online dispute resolution (OS platform), which can be accessed at:http://ec.europa.eu/odr

It is our concern to amicably settle any disputes arising from a contractual relationship. Furthermore, we are not obliged to participate in an arbitration procedure and cannot offer to participate in this procedure.

Section 19 Severability Clause

Should a provision of these General Terms and Conditions be ineffective, the validity of the remaining provisions shall not be affected.

§ 20 The Guarantee

Our company offers a guarantee for all our products. We assure you that all of our products and services meet our strict quality controls. If your product fails during the period specified in the warrantyfrom 2 yearsIf it does not meet the appropriate standards, it will be repaired or replaced free of charge until the warranty is fully honoured.
